Relocation disputes can be very difficult to resolve and sometimes end up in court.

They happen when one parent in a separated family decides to move to another part of the country or another part of the world and the other parent objects because the distance would make it difficult to maintain contact with the children.

The appeal decisions from two recent Scottish court cases concerning relocation give some insight into what the court considers when makng such decisions. 

We are mentioning these cases to help people understand the overall processes, while stressing that all relocation cases have individual circumstances and you cannot assume your case will have the same result as any other one.

In the case of M.S. v. S.S. a father’s appeal against the decision to allow a mother to move to the United states with their son was dismissed in the Court of Session.
