Launch of Shared Parenting Scotland

Speaking at the launch of Shared Parenting Scotland in Edinburgh on 10th February 2020, Sir James Munby described the crisis in public law in the English Courts, making comments about what could change in both Scotland and England to remedy current problems.

He also commented on the way in which English family law was modified in 2014, inserting the presumption that involvement of parents in the life of children will further the child’s welfare unless it can be shown to the contrary.  Sir James was President of the Family Division of the High Court of England and Wales until 2018 and is currently chair of the Nuffield Family Justice Observatory.

Amanda Masson, head of family law at Harper Macleod LLP, spoke about the reasons for including a statement about shared parenting in the Children (Scotland) Bill that is currently before parliament.
